Levoit air purifier buyers have until November 3 to file an online claim in a proposed settlement over HEPA advertising. Eligible purchasers can receive a $10 digital payment, subject to a reduction if valid claims exceed the available fund. Buying a Levoit product alone does not establish eligibility: the model family, advertising language, purchase date and seller all matter.

The official notice sets the deadline but does not state a cutoff hour or time zone. It is worth checking your records now rather than assuming a particular midnight deadline.

The class covers US purchases of Levoit Core or EverestAir purifiers and replacement filters carrying True HEPA, HEPA or H13 language between August 29, 2019, and August 4, 2023. That leaves out purchases outside the stated period and products outside the two named families.

There is also a seller restriction that the notice's short eligibility summary does not spell out. The court's preliminary approval order, on pages 1 and 2, excludes people who bought directly from Vesync's website or mobile app and are accordingly bound by an arbitration agreement and class-action waiver. Check where you placed the order as well as what you bought.

Other exclusions cover government entities, the parties' counsel and firms, Vesync and its related companies and personnel, specified judges and mediators and their families and staff, and people who validly opt out. The order contains the complete definition.

What you need to file

The claim page asks for a claim ID and PIN. It also says a valid claim requires dated purchase evidence, your email, full name, address, signature and choice of payment method. Receiving an invitation does not remove the proof requirement stated on that page.

If you have no ID or PIN, the administrator provides a separate claim route without an email invitation. It begins with contact details and says claimants will then provide proof showing the original purchase date, their full name, address and signature. Use your purchase records to establish the date and product.

ClassAction.org's September 10 report independently describes both routes and the proof requirement. Its earlier reporting also makes clear that this is an approaching deadline for an existing settlement.

One award, with payment still ahead

The settlement agreement provides one award per class member with a valid claim. Multiple qualifying purifiers or filter purchases do not create separate $10 awards under that provision.

The agreement also describes review of claims for completeness and accuracy, with information certified under penalty of perjury. Filing does not establish that a claim has been accepted. The administrator determines validity, subject to the agreement's review procedures.

The notice currently lists a February 17, 2027, fairness hearing at 11 a.m. Eastern, subject to change. Payments depend on final approval and resolution of any appeals. November 3 is the claim deadline, not a payment date.

Claiming, opting out and doing nothing

These choices have different consequences. A valid claim seeks payment. A valid exclusion preserves the ability to pursue your own claims about the issues being settled, but forfeits the settlement award. Doing nothing brings no award and, if the settlement is approved, leaves class members bound by the release.

Exclusion requests must be postmarked by November 3; they cannot be made by phone or email. Follow the notice's required contents and mailing instructions. Objecting is a separate process for class members who remain in the settlement and want to challenge its terms.

The lawsuit alleges misleading filtration advertising. Vesync denies wrongdoing, and the court has not decided the merits. Questions about eligibility, documentation or the release can go to administrator Apex Class Action at 800-837-2979 or [email protected].
